PARENT’S RIGHTS AND SAFEGUARDS UNDER SECTION 504

Section 504 of the Rehabilitation Act of 1973 prohibits discrimination on the basis of disability in programs and activities receiving federal financial assistance.

As a parent/guardian, you have the right to:

  1. Have your child participate in and receive benefits from public education programs and activities without discrimination based on disability.
  2. Receive notice of your rights under Section 504.
  3. Receive notice and provide consent prior to an initial evaluation of your child for Section 504 eligibility.
  4. Have your child receive a free appropriate public education (FAPE). This includes the right to be educated with nondisabled peers to the maximum extent appropriate and to receive reasonable accommodations, aids and services necessary to provide equal access to educational programs and activities.
  5. Have your child educated in facilities and receive services comparable to those provided to students without disabilities.
  6. Have eligibility, evaluation, accommodation, services and placement decisions made by a knowledgeable team using information from a variety of sources.
  7. Receive notice prior to any significant change in your child’s identification, evaluation, educational placement or provision of services under Section 504.
  8. Have your child reevaluated periodically and before any significant change in placement.
  9. Have transportation provided to an alternative placement at no greater cost than would be incurred if the student attended a program operated by the District.
  10. Have your child provided an equal opportunity to participate in nonacademic and extracurricular activities through reasonable accommodations and supports.
  11. Examine and review all relevant educational records relating to your child’s identification, evaluation, educational program, accommodations and placement.
  12. Obtain copies of educational records at a reasonable cost unless the fee would effectively deny you access to the records.
  13. Receive responses from the District to reasonable requests for explanations and interpretations of your child’s records.
  14. Request amendment of your child’s educational records if there is reasonable cause to believe the records are inaccurate, misleading or otherwise in violation of your child’s privacy rights. If the District refuses this request, you will be notified of your right to a hearing.
  15. Request an impartial due process hearing regarding decisions related to your child’s identification, evaluation, eligibility, accommodations or educational placement. You and your child may participate in the hearing and may be represented by an attorney at your own expense. Information regarding the District’s Section 504 due process procedures can be found in District Policy IHBA-RA and IHBA-RB. 
  16. File a complaint with the District if you believe your child’s rights under Section 504 have been violated. Complaints may be submitted to the District Section 504 Coordinator or school administrator.
  17. File a complaint with the Office for Civil Rights (OCR), U.S. Department of Education. The regional office serving Arizona is:
